Description: Article 102 of the Treaty on the Functioning of the EU has a glorious past, having been used by the bloc’s antitrust regulators to inflict real pain on Big Tech — including Microsoft, Google and Intel. But over the past few years, the tool has lost some of its shine, with lawyers, economists and the companies themselves deploying an increased level of sophistication when challenging enforcement action by the European Commission. Now, the EU’s antitrust regulator is working on changes designed to again showcase the weapon it had previously deployed so effectively.
